Divorce in Colorado

Divorce is the legal process that dissolves your marriage. It no longer requires either party to lay blame on the other for the breakdown of the marriage with proof of misconduct presented in court. Thankfully, either spouse can secure a divorce by attesting to irreconcilable differences that leave no room for reconciliation. However, no matter how amicable your breakup may be, you and your spouse will need to resolve the issues relative to your divorce. These issues by themselves can lead to disagreement and dispute because of their impact on you, your spouse, and your children. 

In a Colorado divorce, you will need to resolve:

  • How marital property and debt will be divided. This falls under the state’s policy of an “equitable distribution” which must be fair but not necessarily equal. 
  • Parental responsibility (previously known as child custody). This gives parents the legal right to make major life decisions about the child as well as how the child will spend time with each parent.
  • Child support. This determines the calculation of financial support that one parent will be required to provide the other in raising the child.
  • Spousal support/maintenance. Also known as alimony, this is the financial support one spouse may be required to provide a less financially-advantaged spouse during or after a divorce is finalized. 

In Colorado, you can file for divorce jointly or on your own. The process will likely differ based on whether you have children or not. Either spouse must have lived in the state for a minimum of 91 days and file their petition in the county in which they or their spouse resides. If you file on your own, you must serve the petition and its related documents to your spouse so that he or she can respond. If you have children, you may be required to attend parenting classes. 

If you and your spouse have agreed on all of your particular divorce issues, you may attend a final hearing in which the divorce will be finalized. If you have not come to an agreement on all issues, you may be ordered to mediation and a contested hearing scheduled in which both sides can present their cases.
